Regulatory Issue

The Department of Homeland Security is now involved with inspection of DOT HAZMAT training records. Through early March 2013 some licensees have had a DOT HAZMAT inspection that was performed by either the RAM licensing regulatory agency or a HM (Hazardous Material) Safety Specialist, DOT/FAA. The following is excerpted from modifications in Title 49 which is DOT regulations:

Hazardous Materials; Miscellaneous Amendments (RRR)

AGENCY: Pipeline and Hazardous Materials Safety Administration (PHMSA), DOT

ACTION: Final rule

SUMMARY: PHMSA is amending the Hazardous Materials Regulations (HMR) to make miscellaneous amendments to update and clarify certain regulatory requirements.

DATES: Effective Date: This rule is effective May 10, 2013.

Voluntary Compliance Date: Voluntary compliance with all amendments is authorized March 11, 2013.

o Update the training recordkeeping requirements in § 172.704 to specify that a hazmat employer must make hazmat employee training records available upon request, at a reasonable time and location, to an authorized official of the Department of Transportation or the Department of Homeland Security (DHS).
